Conditions of hire
- -- The Provider is The All Clear Company/TACC UK.
- --The Supplier is a TACC UK permitted provider / authorised sub-contract.
- -- The Hirer is the individual or company requesting provision of skip hire / waste service.
- -- Service is the waste service provided by the provider or approved partners to remove waste on behalf of the Hirer.
- -- Skip site means the place where the deposited skip is placed at the direction of the Hirer.
- -- The hire period is the period from delivery of the skip to the Hirer to the date of collection.
- -- Working days are Monday to Friday.
- -- All conditions apply to all contracts for the supply of waste services by the Provider.
- --TACC UK reserves the right to add, alter, amend or withdrawal any of the terms or conditions without notice.
- --All bookings for waste services are deemed to be an offer by the hirer to purchase the service agreeing to all terms and conditions.
- --All service is offered subject to the availability.
- --The Hirer agrees that their judgement in the selection of waste service is not information supplied to by the Provider.
- -- Variations of all conditions are binding unless agreed in writing between the authorised representatives of the Provider and the Hirer.
- -- TACC UK will endeavour to comply with the Hirers requirements but accepts no responsibility for missed lifts/failure to supply or any delay in supply which may be caused directly or indirectly by any circumstances beyond the Providers control. This includes unforeseen or abnormal conditions by any act or neglect on the part of the Hirer.
- --Waste services may be wholly or partly suspended at the Provider's discretion without liability for any loss resulting from suspension.
- --The Hirer agrees to provide and adequately keep clear all necessary approach roads and sites for the site of the skip.
- --Promptly instruction and prevision must be ready on the arrival of the vehicle to accept delivery/collection.
- --An authorised person must be present at the time of delivery / collection to sign and acknowledge delivery and/or collection of the waste service.
- --The Hirer is fully reasonable for any claim, demand or penalty arising in the period of hire which had not been made clear to the provider in writing. Including 3rd party claims or claims for damages arising or accidents related to any waste services subject of this contract.
- --Time allowed for delivery or picking up of all skips is ten minutes. If the vehicle is kept waiting longer the Hirer is liable for additional charges.
- --The standard time allowance for a Wait & Load waste services are clearly stated on The All Clear Company/TACC UK web site.
- --The Hirer must ensure that all permissions are gained before the waste service can lawfully be deposited. Including permission required under Highways Act 1971 have been or will be obtained before they request the Provider or direct the Driver to deposit skips on the public highway and permission will be kept during the full period of hire.
- --The Hirer must not move the skip from site.
- --The Hirer must ensure that he/she signs a single or multiple consignment transfer note (DOC) declaring the waste type and that the waste is accurately described.
- --No liquids explosives, toxic, or dangerous materials including asbestos, solvents, minerals or greases will be placed in the skip. No fridges/freezers, tyres, batteries or any other waste types deemed as hazards are permitted at any time.
- --If any unauthorised waste is placed in any hire the Hirer will immediately give the notices required to the supplier and the provider.
- --The Hirer is reasonable from the start of hire until collection again by the Supplier.
Including:
- All skips are correctly sited in accordance to relevant permissions.
- All skips are properly lit and coned.
- --No fires are started in the skip.
- --No corrosive acid or noxious substance, liquid cement or concrete placed in the skip.
- --The skip must not be filled higher than the top of its sides
- --Where a skips is located on public or third party property if a waste build up accumulates for any reason in the immediate proximity of the skip, the Provider reserves the right to supply a further skip to contain the additional waste and to transfer the cost to the Hirer.
- --Any damage except fair wear and tear cost will be passed on to the Hirer.
- --Any damage by fire, vandalism or other means will be reimbursed by the Hirer to the Provider, costs for either replacement or repair.
- --The Provider can arrange the removal or repositioning of the skip if required to do so by a highway authority.
- --The Hirer is responsible for the additional cost.
- --Any risk in relation to any skip hire shall pass to this Hirer upon delivery in accordance with the Hirer's request or direction and shall remain with the Hirer until the skip hire period is over.
Refund Policy
- --
Application for refunds must be sent directly to TACC UK in writing.
- --Please note as a company we do not offer cash refunds, we can however apply a credit note, once authorised, to use against future purchases.
Cancellation Policy
- --If the Hirer chooses to cancel the hire, the following charges will be
More than 4 days notice - 25% of total hire charge
1-3 days notice- 75% of total hire charge
Less than 24 hours notice - 100% of total hire charge
- --Cancellation charges apply on all orders once payment has been taken.
Payment
- --The amount and charges for any services shall be as quoted to the Hirer or otherwise as shown in the Suppliers current price list.
- --All skip hire waste service must be paid in advance of the customer hire.
- --On time payments are an essential condition of the Contract.
- --Payment shall not be deemed as made until the Supplier has received full payment or funds have cleared in respects of the full amount outstanding.
- --The Supplier will set reasonable credit limits for the Hirer.
- --The Supplier reserves the right to terminate or suspend the Contract for hire of the hired Goods and/or the provision of Services if allowing it to continue would result in the Hirer exceeding its credit limit or the credit limit is already exceeded.
Ownership Risk & Insurance
- --Risk in the Hire Goods and any Products will pass immediately to the Hirer when they leave the possession or control of the Supplier.
- --Risk in the Hire Goods will not pass back to the Supplier from the Hirer until the Hire Goods are back in the physical possession of the Supplier.
- --Ownership of the Hire Goods remains at all times with the Supplier.
- --The Hirer must not deal with the ownership or any interest in the Hire Goods.
- --This includes:
Selling, assigning, mortgaging, pledging, charging, securing, hiring, withholding, exerting any right to withhold, disposing of and/or lending.
Delivery & Collection
- --It is the responsibility of the Hirer to collect the Hire Goods from the Supplier and return them to the Supplier at the end of the Hire Period.
- --If the Supplier agrees to deliver or collect the Hire Goods to and/or from the Hirer it will do so at its standard delivery cost and such delivery and/or collection will form part of the Services.
- --The Hirer will allow and/or procure sufficient access to and from the relevant site and procure sufficient unloading space, facilities, equipment and access to power supplies and utilities for the Supplier's employees, subcontractors and/or agents to allow them to carry out the Services.
- --The Hirer will ensure that the site where the Services are to be performed is where necessary, cleared and prepared before the Services are due to commence.
- --If any Services are delayed, postponed and/or are cancelled due to the Hirer failing to comply with its obligations the Hirer will be liable to pay the Supplier's additional standard charges from time to time for such delay, postponement and/or cancellation.
Good Hire Care
- --The Hirer must not remove any labels from and/or interfere with the Hire Goods, their working mechanisms or any other parts of them and take reasonable care of the hire goods and only use them for their proper purpose in a safe and correct manner in accordance with any operating and/or safety instructions provided or supplied to the Hirer.
- --Notification to the Supplier must be made immediately in the instance of any breakdown, loss and/or damage to the hire goods.
- --Adequate and proper measures to protect the hire goods from theft, damage and/or other risks must be made by the Hirer.
- --Where the hire goods require fuel, oil and/or electricity ensure that the proper type and/or voltage is used and that, where appropriate, the hire goods are properly installed and maintained by a qualified and competent person.
Breakdown & Faults
- --The Hirer is responsible for all expenses, loss (including loss of Rental) and/or damage suffered by the Supplier arising from any breakdown of the hire goods due to the Hirer's negligence, misdirection and/or misuse.
- --The Supplier will at its own cost carry out all routine maintenance and repairs to the hire goods during the hire Period and all repairs which are required due to fair wear and tear and/or an inherent fault.
- --
The Hirer must not repair or attempt to repair the hire goods unless authorised to do so in writing by the Supplier.
Loss & Damage
- --If the hire goods are returned in damaged, unclean and/or defective state except where due to fair wear and tear and/or an inherent fault in the hire goods the Hirer is liable to pay the Supplier for the cost of any repair and/or cleaning required to return the hire goods to a condition fit for re-hire and to pay the Rental, in accordance with the provisions of clause until such repairs and/or cleaning have been completed.
- --The Hirer will pay to the Supplier the replacement cost of any hire goods which are lost, stolen and/or damaged beyond economic repair during the hire period.
- --The Hirer shall pay the rental for the hire goods up to and including the date it notifies the Supplier that the hire goods have been lost, stolen and/or damaged beyond economic repair. From that date until the Supplier has replaced such Hire Goods the Hirer shall pay, as a genuine pre-estimate of lost rental profit, a sum as liquidated damages being equal to two thirds of the rental that would have applied for such hire goods for that period.
Termination Notice
- --If the hire period has a fixed duration, the Hirer shall not be entitled to terminate the Contract before the expiry of that fixed period unless agreed with the Provider.
- --If the hire period does not have a fixed duration either of the Hirer or the Supplier is entitled to terminate the Contract upon giving to the other party any agreed period of notice.
Liability
- --All warranties, representations, terms, conditions and duties implied by law relating to fitness, quality and/or adequacy are excluded to the fullest extent permitted by law.
- --If the Supplier is found to be liable in respect of any loss or damage to the Hirer's property the extent of the Supplier's Liability will be limited to the retail cost of replacement of the damaged property.
- --Any defective hire goods must be returned to the Supplier for inspection if requested by the Supplier before the Supplier will have any Liability for defective hire goods.
- --The Supplier shall have no liability to the Hirerr if, without just cause, any payment due in respect of the hire goods and/or the Services has not been paid in full by the due date for payment.
- --The Supplier shall have no liability for additional damage, loss, liability, claims, costs or expenses caused or contributed to by the Hirer's continued use of defective hire goods and/or services after a defect has become apparent or suspected or should reasonably have become apparent to the hirer.
- --The Hirer shall give the Supplier a reasonable opportunity to remedy any matter for which the Supplier is liable before the hirer incurs any costs and/or expenses in remedying the matter itself.
- --The Supplier shall have no Liability to the Hirer for any delay and/or non performance of a Contract to the extent that such delay is due to any force majeure events. If the Supplier is affected by any such event then time for performance shall be extended for a period equal to the period that such event or events delayed such performance.
- --All third party rights are excluded and no third parties shall have any rights to enforce the Contract. This shall not apply to any finance company with whom the Supplier has an outstanding finance agreement relating to the hire goods. Such finance company shall, subject to the Supplier's consent, have the right to enforce this Contract as if they were the Supplier. This Contract is governed by and interpreted in accordance with English law and the parties agree to submit to the non-exclusive jurisdiction of the English courts.
Payments
- --The Supplier may insert and present for payment any balance due and unpaid where the Hirer has signed a blank or nil value debit or credit card payment DOC. The Supplier may also process interim payments by credit or debit card at any stage of the Contract.
